Higher Risk Buildings & Amendments to Fire Safety Regulations
The Fire Safety (England) Regulations 2022 came into force on the 23rd January 2023 and introduced new duties under the Fire Safety Order for building owners or managers (responsible persons).
The regulations seek to improve the fire safety of blocks of flats in ways which are practical, cost effective for individual leaseholders, and proportionate to the risk of fire. All buildings are different and specific advice will be required for every building individually.
Depending on the height of your building (whether it is under 11 metres, over 11 meters or over 18 meters) will determine the extent to which new legislation affects your building.
Realty obtains specialist advice relevant for each building under our care, and can assist our Clients on their journey to full compliance.
The Building Safety Act was granted Royal assent on the 28th April 2022. The Building Safety Act will place greater fire safety obligations on the persons and organisations involved with managing buildings above 18 meters.
The Act makes ground-breaking reforms to give residents and homeowners more rights, powers, and protections – so homes across the country are safer. It delivers far-reaching protections for qualifying leaseholders from the costs associated with remediating historical building safety defects, and an ambitious toolkit of measures that will allow those responsible for building safety defects to be held to account. The remediation of fire safety defects is a complex matter and advice needs to be tailored to the specific situation of each Client and building.
Where Realty are appointed on 18 metre plus blocks, we would assist as the Joint Accountable Person, ensuring all regulatory matters are adhered to, and provide a service that will bring your building to a compliant standard and maintain the required level of compliance.
Realty are experienced in obtaining the required legal advice and subsequently liaising with the original developer with a view to them completing the necessary works, at no cost to the leaseholders. Our approach is exhaustive, entirely in apartment owner’s best interests and widely communicated so that everyone is kept abreast of the progress.
Where appointed, Realty would register your building with the Building Safety Regulator, and work with specialist consultants to produce a Safety Case Report. Realty collate all information and work with consultants to compile the Golden Thread of fire safety & structural information, and work with specialist consultants to produce a Residents Engagement Strategy.
When appropriate, Realty would apply to the Regulator on behalf of your building for a Building Assessment Certificate, and arrange regular testing of fire safety equipment and retain records of such testing for inspection by the relevant authorities and the Building Safety Regulator.
